NICHOLLS AND CO WEDDING AND EVENTs

Terms and Conditions

1. General Hire Information Upon sighting your quote, please notify us to confirm acceptance of this quote and the following terms and conditions.

  • Quote valid for 7 days.

  • Nicholls & Co will take reasonable steps to notify the client of any price changes, however final invoice charges are subject to change without notice.

Upon Quote Confirmation

  • For hires over $200 we will invoice 50% of the total cost with the remainder due 30 days before the hire date.

  • Minimum booking of $150.

  • Hires booked within a 30 day period are expected to be paid immediately to confirm booking.

  • Hires to the value of under $200 are expected to be paid immediately to confirm booking.

  • Please note that bookings are not confirmed until payment has been received.

2. Event Cancellation

  • In the case of cancellation, 50% of the booking price is non-refundable or will be charged.

  • In the case of postponement, the deposit will be held until the postponement date as store credit, at the discretion of Nicholls & Cos availability.

  • In the case of full payment being made, the full amount will be held until the postponement date, at the discretion of Nicholls & Cos availability.

  • Any refunds for canceled events are at the discretion of Nicholls & Co, and Nicholls & Co reserves the right to charge reasonable costs incurred for planning, administration, cleaning, loading or setting up for the Hire/Event.

  • Nicholls & Co reserves the right to pass on costs incurred by third party companies to clients in the instance of cancellation or postponement.

  • Once a quote has been invoiced, changes to the invoice are at the discretion of Nicholls & Co.

3. TERMINATION

  • Without prejudice we may suspend or terminate the supply of Equipment and/or Services without liability if at any time.

  • Termination may happen if you breach any obligation under these Terms (including those relating to payment), you become bankrupt, insolvent, a receiver is appointed in respect of your assets, an arrangement with your creditors is made or you cease or threaten to cease carrying on business, or any similar event occurs.

  • Termination may happen if items are used in an unsafe manner or if it is believed equipment and persons are in an unsafe environment.

  • Any charges are non-refundable and the equipment must be returned to us immediately.

  • You agree to indemnify and keep us indemnified against any cost, loss, damage or claim incurred by us in connection with your breach of these Terms.

4. Health and Safety

  • During the use of the hire item(s) it is the Hirer’s responsibility to manage the Health and Safety of participants and equipment involved in the use of the hire. Hire items should always be monitored by a sound and physically competent adult.

  • Any permit required is not the responsibility of Nicholls & Co unless otherwise stated in writing by Nicholls & Co.

5. Cancellation due to COVID-19 Alert Level Changes

In the case of your Event or Hire being Canceled due:

  • Government mandated lockdown

  • The Hirer testing positive for COVID-19

  • The Deposit and/or Full Amount will be held by Nicholls & Co until the postponement date at the discretion of Nicholls & Co availability.

In the case of your Event or Hire being Canceled due to:

  • The Hirer’s preference is that the Event/Hire does not go ahead at the booked time or in the case of Cancellation, 50% of the booking price is non-refundable or will be charged.

6. Residential Wet Weather Cancellation

  • Where Cancellation is made within less than 48 hours notice, any refund or postponement is at the discretion of Nicholls & Co as planning, administration, cleaning, loading or other fees may apply.

7. Collections and Returns

  • Where a client is collecting or returning items, Nicholls & Co reserves the right to charge a late surcharge of $10 per 15 minutes outside the agreed collection or return time.

  • Any changes to the collection or return time must be advised to Nicholls & Co at least 24 hours prior, and will only be confirmed if changes are agreed upon by Nicholls & Co.

  • A client can extend their hire period for a fixed rate, depending on availability. The client must advise Nicholls & Co 24 hours before hire return time and any changes must be agreed by Nicholls & Co.

  • If items are not returned, Nicholls & Co reserve the rights to take these matters further.

8. Specific Hire Item information

  1. Tables and chairs must be returned wiped down.

  2. Glassware, crockery, cutlery and serveware must be rinsed before returning. If items are not rinsed, further charges may apply.

  3. Linen, tablecloths and napkins, must be returned dry. Please advise Nicholls & Co of any stains. Any Linen stored wet will become moldy and incur extra costs.

  4. Drapes and wall silks, must be returned dry. Avoid getting these dirty. Please advise Nicholls & Co of any stains.

  5. Marquee letters and lighting must be returned wiped down and dry in full working order. Please advise if any broken or damaged lamps or cords.

  6. Arcade Machines and Photo Booths must but be returned wiped down and dry in full working order.

  7. Art works must be returned mark free and dry.

9. Additional Charges

  • Extra fees will incur if hire item(s) require a generator, or where hire items are being set up on a surface requiring concrete weights or sandbags.

  • Delivery charges apply and will be calculated upon booking.

10. Damages

  • Any damages made to Nicholls & Cos products and hire items will incur repair or replacement fees with external fees such as (but not limited to) travel, administration, labour hours and insurance excess costs included.

  • Please inform us of damages, dirty equipment or expired goods ASAP.

11. Invoice

  • The remaining balance is due, and must have cleared in full 30 days prior to hire date.

  • Bookings made within 30 days of event must be paid in full.

  • Late payments will incur fees and “payment not received” be forwarded to debt collecting agencies.

  • Any debt collection, legal or other costs incurred in the collection of outstanding amounts will be payable by you, the debtor. Any variation to these terms will be at the discretion of Nicholls & Co.

12. Photography

Nicholls & Co reserve the right to take images of event set ups using Nicholls & Co hire items as well as event styling to use as they see fit on their social media platforms, advertisements and website. Nicholls & Co ask that any professional images taken are shared with them to use on and not limited to the above platforms.

13. Privacy

We collect personal information from you, including:

  • Your name

  • Contact information

  • Billing or purchase information

We collect your personal information in order to:

  • Complete invoices and Quotes

  • Confirm bookings and deliveries

  • Send News letters

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. If you’d like to ask for a copy of your information, or to have it corrected, please contact us at tem@nichollsandco.com

14. Confidentiality

Nicholls & Co will keep all personal information confidential and not disclose the other party’s information, except where required to perform their roles and responsibility, or where required to by law.
